The B.C. Construction Industry Rehabilitation Plan (“CIRP”, “we” or “us”) is a non-profit, joint union/management sponsored alcohol and drug treatment program, providing mental health and substance use services to the BC & YT organized construction industry.

CIRP values the relationships we have with individuals and their personal information. We have put in place a number of measures to manage and safeguard your personal information.

This Privacy Policy (the “Policy”) describes how CIRP collects, uses, discloses, and protects your personal information collected in connection to our website, particularly at https://www.constructionrehabplan.com (the “Site”), the BuildStrong App (the “App”), and any related services we provide as described below (collectively, the “Services”).

GIVING AND WITHDRAWING YOUR CONSENT

Please read this Policy carefully. By visiting and using our Services, including any resources, screeners or aspects of it available at the time, or submitting your information on our “Contact Us” page on the Site, you acknowledge the notices in this Policy. If you do not agree with our Policy and practices, you must refrain from using the Services.

We collect, use, and disclose your personal information with your consent and as permitted by applicable privacy laws. Depending on the information we collect and the purposes for which the personal information will be used, your consent may be express or implied. When you voluntarily provide personal information to us, we will imply your consent to use and disclose that information in accordance with this Policy.

If you wish to withdraw your consent to our collection, use, or disclosure of your personal information, please contact us as set out in the “Contact Us” section below. In some cases, withdrawal of your consent may not be possible due to legal obligations or requirements. Withdrawal of your consent may also mean that we will no longer be able to provide certain Services to you.

If you withdraw consent relating to your personal information, we may choose to delete or anonymize any or all of your personal information in our system. We may also keep a record of your withdrawal of consent.

COLLECTION AND USE OF YOUR PERSONAL INFORMATION

CIRP collects a limited amount of personal information through the Site. We collect personal information in a number of ways, including:

Personal Information You Provide

  • “Contact us” information: We collect your name, phone number, and email address, and any other information you provide when you complete our Contact Us form or send us an email at info@constructionrehabplan.com.
  • Newsletter Subscription: We will collect your email address when you sign up for a Newsletter through our Site. Newsletters sent to your email address will be linked to your name and we may collect information about whether you open the e-mail, access any link(s) provided, what pages you visit on our Site, and how you interact with our offerings.
  • Webinar registration information: If you register for an offering through our Site, we will collect the information you provide in signing up for the webinar, including any details such as the date, quantity, description, price, and information about what you select. CIRP will also keep a record of your order, and its status.

Screeners: We have designed our Services so that we do not collect any of the responses you provide on our screeners. Your responses are captured and retained on your device only and are not provided to CIRP.

Personal Information Automatically Collected When Using the Site

  • Technical and usage information: We use third party providers, such as Google Analytics, to collect information about your engagement with our Services. We may collect information about your device, such as your internet protocol (IP) address, browser type, internet service provider (ISP), platform type, device identifier, manufacturer and model, as well as the operating system you use. With respect to your visit to the Site, we may get information that includes the pages of the Site you visit, when and how long you visit the Site, your actions within the Site (e.g. number of clicks), connection speed, Site crashes and other system activity, the URLs you visited before and after using the Site, and content that you download from the Site.
  • Tracking technology: We may collect personal information when you access the Services via Facebook pixel tags, Google Analytics and other similar tracking technologies. This is addressed further in the “How we use Tracking Technology” section below.

Reasonable Uses of Your Personal Information

CIRP uses personal information for a number of purposes, as permitted by law. In addition to the obvious business and legal purposes for which we may use personal information, and those identified above, our use of personal information includes the following:

  • Communications: We may use your personal information to correspond with you and to manage our relationship, including in relation to requests you make through our Services (Newsletter or purchases) or to respond to your questions, comments, or concerns. We may use your information to provide you with services or information you request. Where we have your express consent to do so, we may also send you commercial electronic messages, which could include general updates and announcements and electronic newsletters (see below for information on how to “opt-out” of receiving certain communications from us)
  • Legal and regulatory requirements: We may use your personal information to meet our legal obligations and for regulatory purposes.

HOW WE USE TRACKING TECHNOLOGY

CIRP uses tracking technologies, such as Google Analytics and others, to collect information as you navigate through the Services. This includes the device, technical, and usage information described in the sections above.

These third-party tools may collect and associate information about your online activities on our Site and across different websites. They may create reports for us about activities on the Site, such as aggregated information about devices, geolocation, networks, page visits, duration of visits, and click through rates. CIRP only uses aggregated data from these services. The third parties may use the information to post relevant content on our Site and other platforms, like Google and Facebook, based on your affinities and demographics.

DISCLOSURE OF YOUR PERSONAL INFORMATION

Except as described in this Policy or in other situations where we have obtained your consent, or are obligated or permitted by law, CIRP will not share your personal information collected through the Site or App with third parties.

In some circumstances, we may disclose your personal information without first obtaining your consent to law enforcement and other governmental authorities when we are required or permitted by law to do so. This could include disclosure for the reporting or investigation of improper or unlawful activities, or to protect CIRP’s or other’s rights and property.

CIRP may disclose your personal information in the good faith belief that such action is legally permitted or necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of CIRP or a related entity or individual
  • Protect the personal safety of users of the Services or the public
  • Protect against legal liability

Third Parties

We will disclose your personal information to trusted third parties when CIRP’s Services or operations require us to provide your information to a third party who performs functions on our behalf. In such cases, we take steps to help ensure our service providers only use personal information for authorized purposes and implement reasonable privacy and security safeguards.

Service Providers: We may share your personal information with certain service providers to help provide, monitor and analyze the use of our Services, to show advertisements to you, to help support and maintain our Services, to contact you, to advertise on third party websites to you after you visited our Services or for payment processing.

Disclosure to Emergency Services when using the timer alarm on the APP

App does not collect any user data without explicit consent. Data collected by the App includes information you provide when registering, such as your 1) Name, 2) Phone Number, 3) Emergency Contact Name, 4) Emergency Contact Phone Number, and 5) Location. This information is stored natively on the device hosting the app, and is not connected or distributed to any party including (our current provider, Lifeguard Digital Health), unless:

  • you do not respond to the timer alarm; in which case the above data will be provided to Emergency Health Services in your province (B.C. or Ontario) and stored per their standard policy;
  • to prevent and investigate possible wrongdoing in connection with the Services;
  • to protect against legal liability as required to comply with any laws, regulations, court orders, subpoenas, or other legal process or investigation.

SECURITY & PROTECTION OF YOUR PERSONAL INFORMATION

CIRP takes reasonable steps to protect your personal information. We use administrative, technical, and physical safeguards to protect against unauthorized access, collection, use, disclosure, and disposal, in a manner appropriate to the sensitivity of the information.

Under some circumstances, we may anonymize or aggregate your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

RETENTION OF YOUR PERSONAL INFORMATION

We will retain your personal information only for as long as is reasonably necessary for the purposes for which it was collected and as set out in this Privacy Policy, and to the extent reasonably necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain certain Site and App usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer.

LOCATION OF DATA PROCESSING AND TRANSFER

We typically process your personal information at our operating offices in British Columbia. We use service providers to assist us with such things as hosting and analytics. These providers are sometimes located in the United States and so your personal information collected through the Services may be accessible by governmental authorities in accordance with the laws in the United States.

CHOICES YOU HAVE ABOUT YOUR PERSONAL INFORMATION

We want you to understand your choices and make informed decisions about the ways in which CIRP uses your personal information.

There are several options available for you to manage your privacy preferences, including contacting CIRP or third parties directly or changing your browser or device settings.

Opting-Out of Communications from CIRP

If you provide us with your e-mail address in our Newsletter sign-up, you consent to receiving messages from us and so you may receive commercial electronic communications from us. These messages will provide you with our contact information and a method to opt-out and unsubscribe from future commercial electronic messages.

You can also opt-out of receiving marketing e-mails from CIRP by contacting us at: info@constructionrehabplan.com.

If you opt-out, we may still use your e-mail address to communicate with you regarding important matters, such as about Services or products that you have purchased. You may not opt-out of receiving communications required by law, or which are necessary to provide you with requested services.

ACCESS AND CHANGES TO, DELETION OF YOUR PERSONAL INFORMATION

You may request access to, or correction of the personal information held by CIRP about you. Any request must be to the CIRP Privacy Officer in writing at info@constructionrehabplan.com, with sufficient detail to enable us to understand the request and identify the subject personal information.

In some cases, you may have a right to request us to delete personal information about you. You can also make this request in writing to info@constructionrehabplan.com. We may not delete your personal information in some circumstances if we have a legal right or obligation to refuse, or if it is not possible due to legal obligations or requirements. Deletion may also mean that we will no longer be able to provide certain Services to you.

When you contact CIRP for any of the purposes above, we may ask for further information to confirm your identity and the nature of your request. We will respond reasonably to your request and in accordance with the law. In some cases, we may need additional time to respond to a request, in which case we will provide you with written notice of the extension.

CIRP may charge a reasonable fee according to the cost required to retrieve and provide access to the requested information. We may provide an estimate of the fee in advance and in some cases, will require a deposit for all or part of the fee.

CHILDREN’S PRIVACY

Our Services are not intended for anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are under 18, we ask that you do not use our Services. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us. We will take steps to delete any information we have collected through the Services about individuals under the age of 18 without verification of parental consent.

OTHER WEBSITE LINKS

Our Services may contain links to other websites that are not operated by CIRP. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

CHANGES TO THIS PRIVACY POLICY

We may update our Privacy Policy from time to time. If you use the Services, you acknowledge notice of the most up-to-date version of the Policy posted at that time.

CIRP’s collection, use, disclosure, and retention of your personal information will be governed by the version of the Policy currently in effect. As a result, we encourage you to periodically review our Policy for the latest information on our privacy practices and to contact us if you have any questions or concerns. Changes to this Privacy Policy are effective when they are posted.
